Pursuant to CCP § 387, counsel for the defendant moves to intervene and to retain the sealing of the search warrant and arrest warrant records.

 

The People and counsel for the moving party, Contra Costa Newspapers, Inc. and the San Jose Mercury News, have no objection to the intervention.

 

Counsel for the defendant requests a continuance of this matter.  Counsel for the moving party objects to the request for a continuance.

 

The Court does not rule on the merits of the petition and the Court, without prejudice to renew, GRANTS A STAY pending ruling from the Fifth District Court of Appeal.

 

This matter is ordered continued to June 3, 2003, at 8:30 a.m. in Dept. 5, for further hearing on Motion to Unseal Search Warrant and Arrest Warrant Records.
