Rick Distaso, DDA

Defendant present with:  Kirk McAllister, Esq.

The Parties, having requested an informal hearing through Judge Wary Ladine for the setting of a motion to seal certain items to be heard in this Court, this Court heard the matter shortly thereafter at 3:45 P.M.

The Parties wish to seal a Ramey arrest warrant affidavit and a search warrant along with a search

warrant affidavit that was executed post arrest.  The Parties filed written motions with points and

authorities.

The Court hereby schedules the matter for Friday May 9, 2003 at 8:30 a.m. in department 8 (Judge Girolami, presiding).  At that time, pursuant to Rules of Court 243.2, the Party requesting the sealing must lodge the sealed documents unless good cause exists for not lodging them.

The request for sealing, if accepted at that time, will require that the records be conditionally sealed and the motion will be heard on the date of the pretrial on May 27, 2003 at 8:30 a.m.

Additionally, the Parties submitted and the Court approved a stipulation authorizing the Court to release copies of all sealed documents to the Parties with a protective order that they not be disseminated beyond their Investigators.  The Court will then reseal and maintain the original documents.

The Defendant is remanded into the custody of the Sheriff.  No bail is set.
