Referral to Probation Department for the Preparation of Probation Report

Judge Delucchi:  All right.   Let the record show the jury's filed out for the morning now.   They've been excused for the remainder of the day. Yesterday we picked February the 25th for a R and S date. The San Mateo County Probation Department requires a minimum of six weeks in order to prepare a probation report.   And so we selected this date which would be convenient to everybody and that would give the probation office enough time to interview the defendant. I've already requested that the defendant remain here in San Mateo County and not be returned to Stanislaus County so he will be accessible to Mr. Geragos and accessible to the probation department.
