Documents admitted and marked as Court Exhibits

November 22, 2004

JUDGE: Then we have a report filed by Deputy Cody from the district attorney's office of San Mateo County in response to a letter the court received and has shared with counsel. I'm going to ask that this be sealed and made as a court's exhibit next in order.

CLERK: It will be 36.

JUDGE: All right. Number 36. Court's Exhibit 36 marked for identification and sealed pursuant to Section 243.1 of the California Rules of Court

GERAGOS: Does the court want to make the findings under 243?

JUDGE: Yeah, for same reasons before. The -- this if -- well, if this information -- first of all, the information -- that was totally bogus, I should say that, and -- and if this was out, it could precipitate the possibility of a mistrial. Okay. And then, even though it's bogus, it's inflammatory, inflammatory information. Turned out to be completely untrue. Then there is a bunch of other stuff the court received by e-mail having to do with Justin Falconer, number 5, and -- and there's some other e-mails with respect to the boat, and then I'm going to file those and make those next in order. A lot of these are unsigned, just critical of counsel and the court. So they can be also filed. Sealed also.

CLERK: 37.

JUDGE: Next in order.

CLERK: Court's 37.
